You may able to claim back the additional SDLT if you sell your previous main home within 3 years of the date of purchase

Most people are aware that if you are not selling your previous home to buy your new property you will be liable to pay a higher rate of SDLT.  From October last year this higher rate has increased to an additional 5% of the total purchase price making it a significant expense. On a purchase price of £400,000 the higher rate of SDLT would mean that the total SDLT payable increases from £7,500 to £27,500!

You may able to claim back the additional SDLT if you sell your previous main home within 3 years of the date of purchase of your new main residence.

What you may not be aware of is that there are occasions when the purchase of a property could be considered a multiple dwelling purchase and this could mean that the higher rate is applicable regardless of the fact you may not own any other property. 

Assessing what would be considered a multiple dwelling transaction for the purposes of the higher rate of SDLT is not straightforward but Relatus are experts in this area. We can advise whether the property you are purchasing would be considered suitable for use as 2 or more dwellings and on many occasions could save you from overpaying your SDLT. 

We can also assist you to reclaim any amounts you have already overpaid where the purchase has incorrectly been stated as multiple dwellings.
