The property being purchased will be subject to a different rate of SDLT depending upon the property being purchased and the purchasers themselves, there are also a number of reliefs available which can reduce the SDLT payable. Despite this HMRC’s SDLT calculator provides only a basic calculation of the amounts due which will often produce a misleading result.
Relatus will work with you before your purchase completes to provide an initial assessment of the correct amount of SDLT payable and will then go on to prepare a detailed written opinion and a full disclosure report supporting the SDLT return with reference to legislation, case law and guidance.
The written opinion can be relied upon to support the SDLT return but we also provide you with a full disclosure report which should be sent to HMRC and this will ensure that the time HMRC have to issue a check into the return is limited to 9 months. If no full disclosure is provided HMRC have up to 6 years to issue a discovery assessment and this can increase the amounts HMRC claim by thousands of pounds!

Post-transaction amendments and refunds
We will review the transaction and advise whether there was an overpayment, if there was, we will prepare a request for amendment of the SDLT return which will detail the reason for the overpayment relying on the relevant legislation, Tribunal decisions and HMRC’s own guidance. We will calculate the correct amount of SDLT and the amount to be refunded.
All requests for amendment will be made on a full disclosure basis to ensure that the compliance period is limited to 9 months. If a compliance check is opened to consider the validity of our amendment, we will deal with the check on your behalf for no additional fee.
A request for amendment resulting in a refund of SDLT is subject to a strict deadline of 12 months from the filing date and it is important that you act fast to avoid losing your ability to claim a refund.
